Second to None

 

Image result for clock at 330 amIn case you missed it, the time stamp on Donald Trump’s Wednesday morning Twitter threat to send our “nice and new and ‘smart!'” missiles into Syria read, “3:47 AM.”  Obviously, Trump had a sleepless night.  But he was not the only one.  I too was up at 3:30 Wednesday morning.  And, as usual, I engaged in one of my favorite pasttimes, making connections where none seem to exist.  In order to identify such intersections of events, it is useful to list the seemingly unrelated occurrences.

  • Monday evening, Donald Trump describes the lawful raid on his personal attorney’s office, home and hotel room as “an attack against the nation.”
  • At the Tuesday briefing, Sarah Huckabee Sanders tells the White House press corps Trump has been advised he has the authority to fire special counsel Robert Mueller, contrary to the language of the law.
  • Trump tweets “Get ready Russia…the missiles are coming.”
  • Paul Ryan announces he will not seek re-election.
  • Former Secretary of State Madelaine Albright launches publicity tour to promote her new book Fascism: A Warning.
  • The NRA joins a law suit to overturn an assault weapons ban in the Chicago suburb of Deerfield, Illinois.

Hard to believe this all occurred over a 48-hour period. Welcome to the Age of Trump.  But where is the nexus?  I believe the unifying element among these events is how they all are governed by the “rule of law.”  Let’s take them one a time.

The unlawful raid on an attorney’s offices and residences could be seen as a violation of the Fourth Amendment, protection against “unreasonable searches and seizures.”  But the Department of Justice followed the letter of the law consistent with the qualifying language, “…upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.” Although not true, from a legal perspective, Trump would have been better served by claiming the FBI’s actions on Monday were “an attack on Michael Cohen” contrary to his personal protections under the Fourth Amendment.  HE DID NOT.

There is a law governing the conduct and, if necessary, the disciplining and removal of a special counsel appointed by attorney general or his designee.  It is embodied in Title 28 Section 600.7 of the U.S. Code of Federal Regulations as follows:

(d) The Special Counsel may be disciplined or removed from office only by the personal action of the Attorney General. The Attorney General may remove a Special Counsel for misconduct, dereliction of duty, incapacity, conflict of interest, or for other good cause, including violation of Departmental policies. The Attorney General shall inform the Special Counsel in writing of the specific reason for his or her removal.

The term attorney general in Subsection (d) is modified by the language in 28 CFR 600.1 by adding, “or in cases in which the Attorney General is recused, the Acting Attorney General will appoint a special counsel…” The White House has not referred to this statute or any other to affirm its belief in Trump’s authority to remove the special counsel. FOR OBVIOUS REASONS. Such authority does not exist.

Instead of a unilateral declaration of military action, Trump could have sought Congressional authority under the War Powers Resolution of 1973, federal law designed to check the president’s power to commit the United States to armed conflict without legislative consent.  Or at a minimum consulted with Congress.  HE DID NOT.

Ryan’s decision to step aside as speaker is a good opportunity to look back at Article I of the Constitution which states:

The House of Representatives shall choose their speaker and other officers; and shall have the sole power of impeachment.

It does not say the members of the majority party shall choose the speaker is a functionary of the House of Representatives.  He is the presiding officer and third in line to the presidency.  He is is an officer of the House of Representatives, not congressional leader of his party.  That is why he is not also given the responsibilities of the majority party.  Has Trump or Ryan once taken that into account.  THEY HAVE NOT.

Although Albright’s book is just the latest to alert Americans that Trump and his minions demonstrate the behavior associated with the rise of past fascist leaders, there are a growing number of books documenting this threat to our democracy and the institutions which preserve democracy.  This book will join a growing list of Trump targets he calls “fake news” or  media as “enemies of the people.”  He could disagree with everything these authors and journalists write and say, but they have that right under the First Amendment.  HE HAS NOT.

Which brings us to the NRA.  It is impossible to count the number of times Trump has invoked the Second Amendment to support the NRA and parrot its positions on the regulation of firearms.  Thus the title of this post.  Donald J. Trump believes in the right to bear arms as “second” to no other law or regulation which governs our fragile democracy.  And his devotion to the language of the Second Amendment is the dog whistle which keeps me up at night.

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

Powerful, but like much of the lexicon we use today, the meaning or inference of specific words morphs over time.  In 1789, a “regulated Militia” was widely viewed as the nation’s citizen army for the sole purpose of defense against foreign invasion.  I don’t remember George W. Bush calling out the militia post 9/11.  Today, a “regulated Militia” is more like an organization, part of a right wing movement such as the Three Percenters, the Hutaree in southern Michigan, the Militia of Montana or the Texas Light Foot Militia.  In 2015, the Southern Poverty Law Center identified 276 such groups across the country.

Consider the term “free State.”  In 1789, that term referred to the former colonies’ freedom from external governance or control.  Today it is a designation more like used by alt-right groups or anti-government cadres which are loyal members of the Trump base.

So, this is my worse nightmare.  The only “rule of law” to which Trump adheres is the Second Amendment and has made it clear that a ban on assault weapons is not in the cards as long as he is in the Oval Office.  But listen to some of the arguments in favor of semi-automatic assault weapons.  Literature available from the Three Percenters warns, “All politics in this country now is just dress rehearsal for civil war.”  But these conspiracy theories are not reserved to fringe elements.  Oklahoma Senator Tom Coburn, in January 2013, said, “The Second Amendment wasn’t written so you can go hunting, it was to create a force to balance a tyrannical force here.”

So, just imagine if Donald Trump becomes the subject of impeachment and possible conviction under Article Two of the Constitution.  It does not take a stable genius to understand he will view such lawful due process as nothing more than “a civil war between his followers and deep state Democrats” or “the country is being taken over by a tyrannical un-elected force.”  The very buzzwords which will incite “citizen militias” to lock and load their semi-automatic weapons and march on Washington, not to peacefully protest (their right under the First Amendment) but to hide behind the SECOND TO NONE AMENDMENT to launch a violent insurrection.

Just in case you think this theory is implausible or the rantings of a conspiracy theorist, I remind of what Trump said at a campaign rally in Wilmington, Delaware on August 9, 2016 about the possibility Hillary Clinton would appoint justices to the Supreme Court who favor stricter gun controls.

If she gets to pick her judges, nothing you can do, folks.  Although the Second Amendment people — maybe there is, I don’t know.

More Human Shields

 

Related imageSome of you may remember the graphic to the right.  It first appeared in 2010 during Israel’s response to Hamas’ indiscriminate launching of rockets from Gaza into Israeli towns and villages.  The message was obvious.  Israel used its military to protect its children, while Hamas hid its weapons and ammunition in schools and hospitals.  The latter’s primary purpose was to lure the Israel forces into harming or even killing innocent women and children in order to score points in the court of public opinion.  Hamas spokespersons denied the Israeli accusations related to human shields throughout the four-year “Gaza War.”  However, in September 2014, Ghazi Hamad, a senior Hamas official, admitted that rocket launchers were positioned close to civilian residences and educational facilities, often within a couple of hundred meters.  (Source: The Daily Mail, September 12, 2014)

The term “human shield” immediately came to mind as I watched Donald Trump’s tirade following the news the FBI had raided the offices, home and hotel room of his consigliere Michael Cohen.   The remarks were made prior to what was presented as a meeting of the national security team to discuss an American response to the Syrian chemical weapons attack.

I want to show you two pictures.  The first is of Trump meeting yesterday with his “war cabinet” in the actual Cabinet Room in the West Wing of the White House.  (NOTE:  This image is a thumbnail of copyrighted photo offered by the European Pressphoto Agency.)  No official White House photos were available.  And I think I know why.  I have personally attended meetings in that room on more than one occasion and I can tell you two things.  First, you may notice it is not what one would call a secured space.  Second, there are no monitors or other audio/visual equipment.    When discussing options for a military response against any nation, the inputs generally consist of two important elements:  classified intelligence and maps/charts of potential targets.

The only reason for holding a national security meeting in the Cabinet Room is to allow photo ops and hold a”press gaggle,” an informal briefing by the president or his representatives.  If you were watching cable news yesterday afternoon, you may have noticed Trumps remarks were not carried live.  Instead, there was a disclaimer on the screen which read, “Moments Ago.”  While comments made during a “gaggle” are on the record, no independent videography is allowed.  In other words, the only video record comes from the White House.

Which brings me back to the issue of human shields.  Donald Trump has a right to express his opinion about actions taken by a Republican FBI director, a Republican deputy Attorney general, a Republican district attorney representing the southern district of New York and a federal judge appointed by Trump himself.  But if he was the “straight-shooting, stand-up guy” he claims to be, he should have addressed the nation from his desk in the Oval Office or from a podium in the East Room.  Even Richard Nixon had the courage to claim (wrongly I might add), “I am not a crook.” during a nationally televised press conference on November 17, 1973.  You do not hold the Joint Chiefs of Staff hostage for the purposes of making it look as though they share your opinion.

But it doesn’t end with yesterday’s dog and pony show.  Trump has not held a formal press conference where he alone answered journalists’ questions in 418 days.  On every other occasion, Trump has had a foreign leader share the podium.  Last week it was the heads of state of the Balkan nations.  Today it was the Emir of Oman.  It’s one thing to ask people who you pay to be your human shields.  It’s another to expect the same of house guests.

Do not be surprised if HBO soon announces a spin-off of its popular drama “Orange is the New Black.” The new series?  “Orange is the New Yellow.”

United States of Amnesia Redux

 

Donald J. Trump may not have faith in American institutions like the separation of powers in the Constitution, the independence of the Department of Justice and the FBI or the judiciary, but he must firmly believe there is a massive outbreak of Alzheimer’s disease among the nation’s populace.  Otherwise, how could he possibly get away with the “malarkey” he tweeted this weekend in response to Bashar al-Assad’s chemical attack on residents of Dourma, Syria.

In his latest iteration of “it is the Black guy’s fault,” Trump tweeted:

If President Obama had crossed his stated Red Line In The Sand, the Syrian disaster would have ended long ago! Animal Assad would have been history!

What the faux-tough-guy-in-chief failed to comprehend was Trump BFF Vladimir Putin actually took Barack Obama seriously.  As sportscaster Warner Wolf used to say, “Let’s go to the video tape!”

Just after midnight on August 21, 2013,  the Assad regime launched rockets loaded with toxins into the Ghouta neighborhood outside Damascus killing more than 1,400 residents including at least 426 children. (Washington Post/August 30, 2013).  To avoid a military response based on Obama’s “red-line” declaration, Russia and the United Nations agreed that all of Syria’s chemical stockpile would be destroyed by June 30, 2014. (UN Security Council Resolution 2118).  The United States actively participated in the destruction of over 600 tons of chemical agents as part of the Russian-USA agreement.

And this is IMPORTANT, there were no further incidences of the use of chemical weapons between August 21, 2013 and January 20, 2017.  Now, I have no idea what Obama actually said to Putin, but I am confident it went something like this.  “You control your boy Assad or we’re going to take him out.”  And guess what?  Putin must have believed Obama meant business.  Yes, Obama made Putin blink despite, and this is equally IMPORTANT, the Republican-controlled House of Representatives refused to take up a resolution supporting military action in response to the chemical attack.  A president’s word alone used to mean something.

Enter Mr. Tough Guy on January 20, 2017.  On April 4, 2017, Syria again deploys chemical weapons on its own people.  On April 7, while dining with Chinese President Xi Jinping at Mar-a-Lago, Trump orders the launch of 59 Tomahawk cruise missiles targeting Shayrat Airbase.  As we later learned, Trump gave Putin an advanced warning of the missile attack and the airbase was again operational within 24 hours.  Maybe that explains why this man is laughing.

So let’s compare the two actions.  Obama backs off of military action and halts further Syrian use of chemical weapons for the remainder of his time in office.  Within three months of Trump taking office, Syria resumes chemical warfare, no doubt with the blessings or at least tacit approval of the Russian government.  Within 72 hours, Trump takes action by launching over $100 million of U.S. missiles and claims:

There can be no dispute that Syria used banned chemical weapons, violated its obligations under the Chemical Weapons Convention and ignored the urging of the UN Security Council. Years of previous attempts at changing Assad’s behavior have all failed and failed very dramatically.

Wrong on two counts.  First, Assad’s behavior had been in check for three and a half years.  And second, as we learned on Saturday, the missile attack in 2017 was ineffective as a deterrent to further deployment of chemical agents against Syrian citizens. Note to anyone in the White House (e.g. Mike Pompeo or John Bolton), this is how diplomacy can be more powerful than military action.

By the way, no one in the mainstream media seems to have picked up on the fact Saturday’s chemical attack on the Dourma neighborhood occurred one year to the day (April 7) after Trump ordered the missile attack on the Shayrat Air Base.  I doubt this is by accident.  If nothing else, in the last 15 months, we have learned Putin allows Trump to occasionally appear to challenge Russia as long as he is no real threat to the Russian government or Putin’s control.  In other words, Trump’s red line in the sand is, “I’m tougher than anyone on Russia.”  But the next wave of inaction against Putin will remind us no writing in the sand is worth much as it disappears as quickly as it is recorded.

e-Lies Coming

 

It is hard not to notice that this is the 50th anniversary of one of the most turbulent years in America’s history.  Every day we are reminded of  the events which contributed to that assessment.  The surprise announcement by Lyndon Johnson on March 31 that he would not seek re-election.  Yesterday’s recognition of the assassination in Memphis of Dr. Martin Luther King, Jr.  The urban riots in the aftermath of King’s death.  And soon the assassination of Robert Kennedy (June 5).

Image result for eli and the thirteenth confessionHowever, a significant event for those of us who grew up on folk music somehow passed under the radar screen.  On March 3, 1968, singer and songwriter Laura Nyro released what many consider her seminal album Eli and the Thirteenth Confession.  Although the album does not rank as one of Nyro’s more commercially successful ventures, it ushered in an era of “fusion” music bringing together elements of folk, soul, gospel and rock.  Numerous tracks were re-released as covers by groups including Three Dog Night and The Fifth Dimension.  And six tracks from the album were included in the Alvin Ailey Dance Theater’s ballet Quintet.

As I often remind those of you who regularly follow this blog, the topic of any particular post and the context in which it is presented seldom results from any planned, analytical process. Instead, it is based on random observations which trigger our curiosity.  In other words, we see something and wonder, “What is this trying to tell me?”  In this case, the trigger was Wisconsin governor Scott Walker’s tweets following the election of liberal Rebecca Dallet to the state’s Supreme Court, beating NRA-backed conservative Michael Screnock by 12 percentage points.

Tonight’s results show we are at risk of a #BlueWave in WI. The Far Left is driven by anger & hatred — we must counter it with optimism & organization. Let’s share our positive story with voters & win in November.

Big government special interests flooded Wisconsin with distorted facts & misinformation. Next, they’ll target me and work to undo our bold reforms. We need to keep moving #WIForward & make sure a #BlueWave of outside special interest money doesn’t take us backward.

We have come to expect this kind of digital rhetoric from the White House, but now these electronic falsehoods were coming at us from more than just Pennsylvania Avenue.  This is what Carl Jung referred to as a “synchronistic moment,” a connection where none seems to exist.  E-lies coming.  What is this trying to tell me.  It was time to re-explore the lyrics of Nyro’s song “Eli’s Coming” and sure enough, there was the association.

Eli’s coming, better walk, walk
But you’ll never get away
No, you’ll never get away from the burning heartache
I walked to Apollo by the bay
Everywhere I go though, Eli’s coming
(She walked but she never got away)
Eli’s coming

And that is what is at the core of the resistance and what Scott Walker does not understand.  It is not anger and hatred that is driving this movement.  It is anger and heartache.  Heartache watching the erosion of the values and ideals on which the United States was founded.  Heartache because those with the power to do something about it not only sit silently, but by their muteness, enable and encourage more attacks on our democracy and the institutions which were designed to protect democracy.

And yes there is also anger which is driving this movement.  But it is internal anger.  Anger that too many of us were complacent and did not understand what was at stake.  Anger at ourselves for waiting too long before taking to the streets or writing postcards.  Anger for believing we could not make a difference.   As Shakespeare reminds us, “The fault is not in our stars, but in ourselves.”

Now we know we should have listened to Laura Nyro.  “You’ll never get away.”  And the worse may be yet to come.  The White House is being populated by more liars and sycophants.  And as we learned this weekend, Sinclair Broadcasting is turning local news programs into Pravda-like mouthpieces for the administration.  But Nyro was only half right.  It is not time to walk. It’s time to run.  As hard as we can.  As though our lives depend on it.

West Wing Story Redux

 

If you really want to understand the culture war currently being fought out in America, all you need to do is observe the reaction of Donald Trump’s surrogates to artistic efforts designed to update classical theater.  The latest example was Bill O’Reilly’s tweet during the NBC presentation of “Jesus Christ Superstar.”

In the latest version of “Stand by Your Man,” Chrissy Teigen,  wife of performer John Legend who starred in the title role, replied, “Yes, the shop specializes in coverups that aren’t 32 million dollars.”

NBC’s holiday special is just the latest in a long history of making classical theater relevant to a new generation.  In 1988, Joseph Papp staged “A Midsummer’s Night Dream” in turn of the century Brazil instead of ancient Athens.  In 1995, Richard Loncraine directed Ian McKellen and Annette Bening in a version of “Richard III,” as a commentary on how a fascist alternative in 1930s England might have emerged during the worldwide depression.  Sometimes understanding the deeper meaning behind a theatrical work requires witnessing the story in two time-frames within the same production.  Such is the case in Stephen Sondheim’s “Sunday in the Park with George.”

But of course, no play has been interpreted in so many different styles or set in so many diverse locales as Shakespeare’s “Romeo and Juliet.”  In 1996, Leonardo DiCaprio and Claire Danes portrayed the star-crossed lovers in modern day Verona Beach.  Or Jerome  Robbins and Robert Wise’s Oscar winning musical translation of this tale of forbidden love to the streets of New York City, West Side Story.  And with each update, there remains the same lingering question, “What could possibly be the next iteration?”  I’m glad you asked.

Dear readers, be prepared to experience “West Wing Story,” the unrequited love between the leaders of two adversarial nations who just want to be left alone to pursue their dreams of global domination.  This new production was scheduled to open in January 2017, but ran into numerous problems during its pre-Broadway run.  Some of the financing had been frozen.  Several of the actors have been indicted or pleaded guilty to crimes.  Having never been rewarded for their efforts, others in the original cast jumped ship and auditioned for other musicals, including Les Deplorables, My Fair Porn Star, The Lyin’ King, Avenue K and Melania Mia!

But fear not, West Wing Story is coming to a courtroom near you.  And just to whet your appetite, let me share the casting and a few of the hit songs from the soundtrack.

Spoiler Alert!  Regardless of the age of the actors in each staging — Leslie Howard and Norma Shearer in 1936 to Leonard Whiting and Olivia Hussey in 1968, the ending is always the same.  The unintentional but inevitable demise of the two lovers.  And in the vein of the original Shakespeare, Lieutenant Schranks (aka Bob Mueller) will close the final scene with words similar to those of Prince Escalus of Verona:

Go hence, and speak no more of these sad things; 
Some shall be granted immunity, but many punished: 
For never was a story more disgusting and phoney
